Plain words on what we collect, why, who sees it and how long we keep it. Last updated 28 September 2026.

Who we are

Not My Fault Limited, company number 826323, Venture Hub, 136 Capel Street, Dublin, D01 T2C9, Ireland, is the data controller: the company responsible for your personal data. To ask about your data, call 0818 294 336 or write to the address above, marked "Data protection".

What we collect

  • Your details: name, phone number, address, email, date of birth where a hire company needs it, driving licence details where a hire company needs them.
  • The crash: what happened, when and where, the other driver's details, witness details, Garda details, photos and any documents you send us.
  • Your car: registration, make and model, mileage, its condition, repair estimates and assessments.
  • Calls and messages: calls to our line are answered by an automated assistant and may be recorded and transcribed; WhatsApp messages and photos you send us; emails.
  • The claim: correspondence with insurers, assessors, garages and hire companies, and payment details for settling the claim.
  • This website: our hosting provider keeps short-lived server logs, including your IP address, to keep the site running and secure. We do not use tracking cookies or analytics tools on this site.

Why we use it, and the legal basis

We do not sell your data and we do not use it for advertising to you.

Who we share it with

Only the people and companies needed to run your claim, and only what each of them needs:

  • The other driver's insurer, and your own insurer where you ask us to notify them.
  • The independent assessor who inspects your car.
  • The garage that repairs it.
  • The hire company that supplies a replacement car.
  • A solicitor, only where you appoint one and ask us to pass the file on.
  • The GardaĆ­, a court or a regulator, where the law requires it.

We also use service providers who process data on our behalf: our phone system (which answers, records and transcribes calls), our customer records system, our email and document tools, WhatsApp for messaging, and our website host. Some of these providers store data outside the European Economic Area, including in the United States. Where they do, we rely on the safeguards the GDPR allows, such as the European Commission's standard contractual clauses or the EU-US Data Privacy Framework where the provider is certified under it.

How long we keep it

Enquiries that do not become a claim: 12 months, then deleted. Claim files: for as long as your claim is open, and for six years after it closes, which matches the general time limit for legal claims about damage to property. Call recordings: 12 months, unless they form part of a claim file. After those periods the data is deleted or made anonymous.

Your rights

You can ask us for a copy of your data, ask us to correct it, ask us to delete it, ask us to limit how we use it, object to our use of it, and ask for it in a form you can take elsewhere. Where we rely on your consent, you can withdraw it at any time. To do any of these, call or write to us using the details above. We reply within one month.

If you are not happy with how we handle your data, you can complain to the Data Protection Commission, 6 Pembroke Row, Dublin 2, D02 X963, dataprotection.ie.

Changes

If we change this notice we will change the date at the top. Significant changes will be explained here in plain words.
